Oregon Class Action Lawsuits - Charity Care

Judge Marilyn Litzenberger gave final approval on June 23, 2006, to the first class action settlement in the nation in a lawsuit alleging that a nonprofit hospital system illegally overcharged the uninsured.  We and our co-counsel filed the case in Oregon state court against Providence Health System and Providence Health System-Oregon. 

Also, on July 20, 2006, Judge Richard Baldwin gave preliminarily approval of a settlement in a similar class action lawsuit filed against Legacy Health System, Legacy Good Samaritan Hospital and Medical Center, and Legacy Mount Hood Medical Center (collectively, "Legacy").  On October 4, 2005, Judge Richard Baldwin certified that case as a class action, the first such class certification in the nation. 

The lawsuits allege that the hospital systems purport to provide charity care, but that they unlawfully discriminate against uninsured patients who are to benefit from charity care by charging them inordinately inflated rates, and that these rates are far higher than rates the hospital systems charge insured patients for the same services.
